ORDINANCE NO.41 Series of 2001 AN ORDINANCE REVISING AND RECTIFYING THE SCHEDULE OF FAIR MARKET VALUES OF REAL PROPERTIES IN THE MUNICIPALITY OF TAGUIG, ACCORDINGLY ESTABLISHING AND ADOPTING THE SAID REVISED AND CORRECTED SCHEDULE, CLARIFYING AND REMOVING THROUGH THE NEW SCHEDULE THE CONFLICT, CONFUSION AND PROBLEMS CREATED BY TWO DIAMETRICALLY OPPOSED ORDINANCES WHICH ADOPTED EXTREMELY EXHORBITANT AND OUTMODEDLY LOW MARKET VALUES AND FOR OTHER PURPOSES Authored by: Coun. Gutierrez WHEREAS, Republic Act No. 7160, otherwise known as “The Local Government Code of 1991”. Mandates that local Government units shall now implement a system to generate resource through revenue legislative that can make them self-reliant and able to sustain the development in order to improve the quality of living of their constituents; WHEREAS, in 1993, this body passed and approved Ordinance 24-93 which revised MMC Ordinance No. 03, Series of 1980; WHEREAS, ostensibly in the exercise of the authority granted by the Local Government Code, the previous municipal administration had asked the Sangguniang Bayan to adopt Ordinance No. 70, Series of 1999, entitled “An Ordinance Revising, Enacting And Adopting The Schedule Of Fair Market Values Of Real Properties In The Municipality of Taguig And For Other Purposes” but as it turned out the market values established in the said Ordinance were extremely oppressive and exorbitant; WHEREAS, the same municipal administration, three (3) days before it was to turn over the reins of government to the present administration, in another unreasonable and regressive move had again prevailed upon the Sangguniang Bayan to enact Ordinance No. 14, Series of 2001, entitled “An Ordinance Repealing Ordinance No. 70, Series of 1999” which resulted in the restoration of the extremely unrealistic and outmodedly low market values established in Ordinance No. 24, Series of 1993, otherwise referred to as the 1994 Schedule of Fair Market Values of Real Properties; Page No. 2 Ordinance 41 Series of 2001 x------------------x WHEREAS, there is an imperative need to resolve the conflict confusion and problems created by the two diametrically opposed ordinances and the most viable solution is to revise the prevailing schedule, whichever it is, and come out with realistic, dynamic, and responsive market values; WHEREAS, the Municipal Assessor, in sync with concerns of the present municipal administration, has prepared a new Schedule of Fair Market Values for all kinds of real properties; WHEREAS, the rapid urbanization of the Municipality of Taguig and its eventual conversion to city hood calls for a more progressive, modern and adequate delivery of basic services and construction of needed infrastructure project; WHEREAS, in order that the local government unit may generate funds to attain the above goals and speed up the modernization of the Municipality and address the problems spawned by the last two real estate tax ordinances, it is imperative that a general and curative revision of real property assessments be undertaken. NOW THEREFORE, BE IT ORDAINED by the Sangguniang Bayan that: SECTION 1. TITLE – This Ordinance shall be denominated as “Ordinance Adopting the Schedule of fair Market Values of Real Properties”. It shall also be known as the “Curative and Clarificatory Real Estate Tax Ordinance of 2001”. SECTION 2. DEFINITION OF TERMS: 1. Residential land – land principally devoted to habitation. 2. Commercial land – land principally devoted for the object of profit and is not classified as agricultural, industrial, mineral, timber or residential land. 3. Industrial land – land devoted principally to industrial activity as capital investment and is not classified as agricultural, commercial, timber, mineral or residential land. 4. Agricultural land – land devoted principally to planting of trees, raising crops, livestock’s and poultry, dairying, salt-making, inland fishing and similar activities and is not classified as mineral, timber, residential, commercial, industrial or raw land. 5. Raw land – refers to land not devoted principally to the planting of trees, raising crops, livestock’s and poultry, dairying, salt-making, inland fishing and similar activities and is not classified as mineral, timber, residential, commercial or industrial land. 6. Special class – all lands buildings, and other improvements thereon, actually, directly, and exclusively used for hospitals, cultural or scientific purposes and those owned and used by local water districts and government owned or controlled corporations rendering eventual public services in the supply and distribution of water and/or generation and transmission of electric power. Page No. 3 Ordinance 41 Series of 2001 x------------------x SECTION 3. GENERAL PROVISIONS A. Whenever a parcel of commercial land is situated at the corner of two streets, a corner influence of 25% of the base unit market value shall be applied and added to the valuation of said lot. Provided, however, that if the streets or roads have different base unit market value the higher base unit market values shall be used in the computation thereof. B. Adjustment of frontage shall be added to the valuation of all commercial lots fronting a street or road. The same shall be derived by multiplying the length of the lot frontage in linear meters by 40% of the base unit market value thereof. C. For low, sunken and or flooded areas of land, reduction, from the base unit market value per square meter shall be made due to the cost filling and compaction to bring the same at par with the adjoining developed lots, provided, however, that such reduction shall be from 20% of the base unit market value. D. Roads or streets in urban subdivisions, unless already donated and turned over to the government, shall be listed separately as taxable in the name of the subdivision owner or homeowners association, as the case maybe. The same shall be valued at 20% of the base unit market value prescribed, thereof, of all kinds of land, and the assessment level to be used is that applicable to the particular area where they are located. E. Park and open space shall be valued at 20% of the base unit market value and assessment level to be used are those applicable to the particular area where they are located. Vacant lot in a purely residential shall be classified as residential. the stripping and valuation thereof shall be based on the principal street or road with higher base value. G. 40% of the base value for the remaining area. The foregoing rule shall not apply to residential and commercial subdivision. Residential and Industrial) lands shall be applied to all lands within the first strip of 40 meters on commercial and residential section and within 50 meters on industrial zone Front-asphalted or concrete streets or roads. ASSESSMENT LEVEL ON LANDS . the zoning ordinance shall be used. however. that in case the parcel of land abutting two streets or roads on the two side with different base value. otherwise known as the Local Government Code of 1991. 90% for the second strip. A reduction of 10% shall be applied from the base value fixed for lands along gravel. or creek shall be valued 20% of the base value per square meter in the area and the assessment to be used are those applicable to the area where they are located. SECTION 4. H. however. All undeveloped parcels of land shall have 70% of the base value applicable in the area on 60% for land inhabited by squatters. the appraisal and assessment shall be adjusted accordingly. All other interior lots shall be valued in accordance with rule H hereof. improved and cleared of squatters. In similar manner. canal. commercial or industrial lands as fixed in the schedule for area where such land is located. the same shall be classified as commercial or industrial. the appraisal and assessment of same shall be adjusted accordingly.
