The only remedy for non- Muslim spouses and children for such relief would be in the Civil Courts since the Syariah Courts do not have jurisdiction over non-Muslims.” Decision followed in Yong Fuat Meng v Chin Yoon Kew [2008] 5 CLJ705  Dalip Kaur v Pegawai Polis Daerah Bukit Mertajam [1991] 1 CLJ (Rep) 83 - Clear provisions should be incorporated in all State Enactments to avoid difficulties of interpretation by the civil courts. - The new Clause 1A of Article 121 of FC has taken away the jurisdiction of the civil courts in respect of matters within the jurisdiction of the Syariah Courts. - Obiter: The question whether a person is a Muslim or apostate is a serious issue which requires the consideration be made by qualified Islamic jurists. The only forum qualified to do so is the Syariah Court.  Soon Singh v Pertubuhan Kebajikan Islam Malaysia Kedah & Anor [1999] 2 CLJ 5 - The Syariah Court derives its jurisdiction under State law enacted pursuant to Art. 74(2) of FC following para. 1, State List of Ninth Schedule. - On matters relating to conversion to Islam, all State Enactments expressly confer the Syariah Courts jurisdiction to deal with the matter. - However, only some State Enactments contain express provisions with respect to conversion out of Islam e.g. Pahang, Negeri Sembilan and Kelantan. - Since matters on conversion to Islam come under the jurisdiction of the Syariah Courts, by implication conversion out of Islam should also fall under the jurisdiction of the same courts.
