AN ORDINANCE CREATING THE MALAYBALAY CITY YOUTHDEVELOPMENT OFFICE, A CITY DEPARTMENT, DEFINING ITS POWERS AND FUNCTIONS, PROVIDING FOR ITS STAFFING PATTERN, APPROPRIATING FUNDS THEREOF AND FOR OTHER PURPOSES SECTION 1. Short Title. –This Ordinance shall be known as “AN ORDINANCE CREATING THE MALAYBALAY CITY YOUTH DEVELOPMENT OFFICE”. SECTION 2. Declaration of Policy. – It is a declared policy of the city to promote and protect the physical, moral, spiritual, intellectual and social well-being of the Filipino youth, inculcating in them patriotism and nationalism, and encourage their involvement in public and civic affairs. SECTION 3. Objectives. –Pursuant to the above declaration, the City shall adopt the following objectives: a) General objectives: a. To develop and harness the full potential of the youth as responsible partners in nation-building; b. To encourage intensive and active participation of youth in all government and non-government programs, projects, and activities affecting them; c. To harmonize all government and non-government initiatives for the development of the youth sector; and d. To supplement government appropriations for youth promotion and development with funds from other sources. b) Specific objectives: a. To broaden and strengthen the services provided by the national government agencies, local government units and private agencies to young people; b. To provide information mechanism on youth opportunities on the areas of education, employment, livelihood, physical and mental health, capability-building and networking; c. To increase the spirit of volunteerism among the youth of the City particularly in the maintenance of peace and order and preservation, conservation, and protection of the environment and natural resources within their respective locality; d. To provide monitoring and coordinating mechanism for youth programs, projects and activities; and e. To provide venue for the active participation of the youth in cultural and eco-tourism awareness program. SECTION 4. Definition of Terms. –The following terms, as used in this Ordinance, are defined as follows: a) “City” shall refer to the City of Malaybalay; b) Office or Malaybalay City Youth Development Office shall refer to the office which is created by this Ordinance; c) Local Youth Development Officer refers to the designated official mandated to head the Office; d) Policy and Planning Officer refers to the personnel of the Office under the Local Youth Development Officer who shall head the policy and planning division of the Office; e) Administration and Finance Officer refers to the personnel of the Office under the Local Youth Development Officer who shall head the administration division of the Office; f) Programs and Operations Officer refers to the personnel of the Office under the Local Youth Development Officer who shall head the programs and operations division of the Office; g) “MOOE” refers to Maintenance and Other Operating Expenses of the Office. h) “Networking/Linkages” refers to the cultivation of a productive exchange of information and services and support of projects among individuals, associations or institutions, business groups, and local government units. i) Division shall refer to the three (3) divisions of the office namely Policy and Planning, Administration and Finance, and Program and Operations Divisions; j) Commission shall refer to the National Youth Commission created under RA 8044; k) Local Youth Development Plan shall refer to the city youth development plan as defined under RA 10742; l) “Stakeholders” refer to youth stakeholders which includes any individual or groups involved, interested in, or affected by youth. Youth stakeholders include youth professionals, public authorities, media and the local community. m) Youth shall refer to a person who age ranges from fifteen (15) to thirty (30) years as provided under Republic Act No. 8044. Sec. 5. Creation of the City Youth Development Office. –The Malaybalay City Youth Development Office, as a City Department, is hereby created and organized. The Local Youth Development Officer shall take charge of the Office. The City Mayor shall appoint the Officer with the rank of City Government Division Chief, Grade 26, pursuant to Section 455 (b) (1) (v) of R.A. No. 7160 otherwise known as the Local Government Code of 1991; provided that he is a citizen of the Philippines, a bona fide resident of Bukidnon, of good moral character, be preferably not more than thirty years of age at the time of her/his appointment; must have acquired experience in youth development affairs or involvement in youth or youth-serving organizations for at least three (3) years; civil service eligible or its equivalent and he or she shall be appointed by the concerned LCE, but in no case is he or she be within the fourth (4th) civil degree of consanguinity or affinity of the appointing authority. SECTION 6. Mandate – The Office shall be the primary planning, programming, coordinating, implementing, assisting and regulatory city office in the promotion and development of the local youth and the various youth affairs concerns in the City in accordance with R.A. 10742, otherwise known as Sangguniang Kabataan Reform Act of 2015. It shall instill in the Bukidnon Youth nationalism and patriotism, and the youth’s fundamental importance not only for today but as an inter-generational responsibility for the future to come. Section 7. Powers and Functions – The Office shall have the following powers and functions: a) In accordance with Section 24 (d) of these rules, register and verify youth and youth-serving organizations (Subject to the revitalized Youth Organizations’ Registration Program (YORP) guidelines); b) Provide technical assistance to the LYDC of the concerned LGU in the formulation of the LYDP; c) Facilitate the election of the LYDC representatives; d) Serve as secretariat to the LYDC; e) Conduct the mandatory and continuing training of SK officials and LYDC members, in accordance with the programs jointly designed and implemented by the Commission and the DILG. The local youth development officer and/or his or her staff shall apply for accreditation from the Commission in order for them to conduct the mandatory and continuing training programs of SK officials and LYDC members. f) Provide technical, logistical and other support in the conduct of the mandatory and continuing training programs, and to such other programs of the Commission and DILG; g) Coordinate with the Commission, with regard to the youth programs within their jurisdiction; and h) Perform such other functions as may be prescribed by law, ordinance, or as the LCE, the DILG or the Commission may require. Section 8. Structure of Departments – The Office shall have Three (3) Divisions which shall be composed of Policy and Planning, Administration and Finance, and Programs and Operations. Section 9. Organizational Structure and Powers and Functions of the Divisions. – The Office shall be supervised directly by the Officer. The Office shall implement and adopt the herewith attached staffing pattern/organizational chart (Annex A) in accordance with the rules and regulations of the Civil Service Commission: a) Policy and Planning - this division provides support services in the areas of policy formulation and evaluation; formulation, updating and monitoring of the City Youth Development Plan; youth and youth affairs development, research and statistics, local incentive program; and coordination with intra- government, local community, and the industry. It shall also supervise and monitor youth-related facilities operated by the city government. b) Administration and Finance – this Division shall provide the Office with staff assistance, control and advice on personnel information, records, communications, supplies and materials, equipment and other facilities, disbursements, budgeting of MOOE; and other liaison, custodial and inventory work and other functions as may be assigned by the Officer. c) Programs and Operations – this division shall be responsible for variety of significant activities promoting and protecting the overall well-being of the youths. This division oversees the programs and operations of the members of the council and provide them with guidance, strategies and operational assistance. Moreover, this division is responsible in conducting pre- and post-training of aspiring SK and elected SK officials, reviews qualifications and appointments of the members of the council, facilitate the accreditation of various youth organizations, and supervise the data collection and maintenance of the database containing various data of each youth, and other necessary related functions that may be assigned to this division. Section 10. Creation of Corresponding Plantilla Positions. – To effectively and efficiently carry out the various functions of MCYDO, the following plantilla positions are hereby created: a) One (1) LOCAL YOUTH DEVELOPMENT OFFICER (HEAD) – SG 26 a. In-charge of the over-all management and operation of the office; b. Sets directions and priorities of all programs; c. Supervises/conducts strategy sessions with the staff on major aspects and decisions affecting program implementation and operations; d. Conducts regular field visits to spot check and get feedback on the development and needs of programs and beneficiaries; e. Reports regularly to the City Mayor the status of all programs; f. Establishes multi-sectoral linkages/networking and coordinate closely stakeholders relative to its various projects and programs; g. Recommends annual budgetary requirements; h. Perform other related administrative functions. b) One (1) Local Development Officer IV in each division – SG 22 a. Assist the Local Development Officer IV in discharging the functions of the office; b. Diligently attend to their respective functions and duties indicated in Sec. 9; Section 11. Funding. – The budgetary requirements upon the effectivity of this Ordinance shall be included in the annual budget beginning CY-2018. Section 12. Transitory Provisions. – The transfer of powers and functions from a Division under the Office of the City Mayor to a newly-created City Department shall include all applicable funds, personnel, records, property and equipment, as may be necessary. There shall be no mandatory separation of any employees as a result of the creation of the Malaybalay City Youth Development Office. All officers and rank and file currently serving in the, Office of the City Mayor, shall continue to serve until replaced, transferred, promoted or changed in position title. SECTION 14. Repealing Clause. – All ordinances and administrative circulars and executive orders or parts hereof which shall be found to be inconsistent with provisions of this Ordinance shall hereby be repealed and amended accordingly. SECTION 15. Separability Clause. – If any part of this Ordinance shall be held unconstitutional or invalid, other parts or provisions hereof shall not be affected and shall continue to be in full force and effect. SECTION 16. Effectivity. This Ordinance shall take effect on January 1, 2018.
